Preamble

The Olaf Wishlist website (hereinafter "the Website" or "the Service"), the mobile application and the browser extension are published by Fabien Sintès - EI, a French sole proprietorship (Entrepreneur individuel) trading as "Olaf Wishlist", registered with the Trade and Companies Register (RCS) of Bourg-en-Bresse under number 517 581 450, with its registered office at 651 rue de la Poste, 01430 Vieu-d'Izenave, France (hereinafter "the Publisher" or "we"). These Terms of Use (hereinafter "Terms") form the contract between the Publisher and any person who accesses the Service (hereinafter "you"); they govern access to and use of the Service. By accessing the Website or creating an account, you unconditionally accept these Terms.

Service Description

Olaf Wishlist is a wishlist creation and sharing service that is free for its users: you are charged no subscription or usage fee. The only amount you may ever be invited to pay is an optional support tip when contributing to a cash gift (see the "Cash Gift" section). The Service allows users to:

  • Create and manage personal wishlists, private (within groups) or public (accessible without an account)
  • Create private memo lists to note your personal wishes
  • Add items with information, images, and links to online stores
  • Share your lists with closed groups (family, friends) via invitation
  • Reserve items on other members' lists, in full or partially (quantities)
  • Participate in collective contributions to co-fund a shared gift
  • Contribute money to the cash gift of a public wishlist, with payments processed by our payment service provider
  • Communicate via per-item discussion threads with your group members
  • Manage lists for third parties without an account (children, relatives)
  • Use the browser extension to add products from e-commerce sites or detect matches with your lists
  • Receive notifications by email and in the application about activity on your lists and groups
  • Access the service via the website, the mobile application, or the browser extension

Access to the Service

Registration

Access to certain features of the Website requires creating an account, either by direct registration (email and password) or through a third-party service (Google, Facebook, Apple). You agree to provide accurate information and keep it up to date. You are responsible for the confidentiality of your login credentials.

Availability

We strive to ensure the availability of the Service 24/7, but cannot guarantee uninterrupted access. Interruptions for maintenance may occur.

User Obligations

By using the Service, you agree to:

  • Comply with these Terms and applicable laws
  • Not use the Service for illegal or unauthorized purposes
  • Not publish illegal, defamatory content, or content infringing the rights of others
  • Not attempt to compromise the security or operation of the Website
  • Not collect data from other users without their consent
  • Respect intellectual property rights

User Content

Ownership

You retain ownership of the content you post on the Website (descriptions, images, etc.). By posting them, you grant the Publisher a non-exclusive, royalty-free license to display and store them as part of the Service.

Moderation

We reserve the right to remove any content that violates these Terms or applicable laws, without prior notice or justification. Testimonials submitted by users are subject to automatic moderation prior to publication.

Collective Contributions (Private Groups)

The Service allows group members to collectively contribute toward funding a shared gift (contribution). Each participant indicates the amount of their participation. The contribution initiator is responsible for closing it. These group contributions are a purely declarative organizational tool: no payment is processed in this context, and Olaf Wishlist cannot be held liable for the actual settlement of amounts between participants. They are distinct from the cash gift offered on public wishlists, which allows genuine monetary contributions (see the "Cash Gift" section).

Public Wishlists

Public wishlists are accessible without creating an account. Visitors wishing to reserve an item must provide their email address and a name to confirm the reservation. This data is processed in accordance with our privacy policy. The list creator can only view reservations after the event date.

Cash Gift (Monetary Contributions on Public Wishlists)

The creator of a public wishlist can activate a cash gift allowing visitors to contribute money for their benefit (the "beneficiary"). This feature is governed by the following rules:

  • Payments are processed by our payment service provider, Stripe Payments Europe, Ltd. ("Stripe"), an institution authorized within the European Union. Olaf Wishlist never holds the funds: each contribution is paid directly into the beneficiary's Stripe payment account and then transferred to their bank account according to Stripe's payout schedule.
  • No card details ever pass through Olaf Wishlist: the payment page is hosted by Stripe, which ensures compliance with banking security standards (PCI DSS).
  • To receive funds, the beneficiary must create a Stripe account and complete the identity verification required by regulation. Until this verification is complete, the cash gift cannot receive contributions.
  • Olaf Wishlist charges no commission on contributions. Stripe's banking fees are deducted from the amount received by the beneficiary. The contributor may add an optional support tip for Olaf Wishlist: its amount is clearly displayed before payment and can be adjusted, including down to zero.
  • The list creator can see the total amount collected at any time; the details of the contributions (names, messages, individual amounts) are only revealed to them after the event date.
  • Contributions are possible up to and including the day of the event.

Regulatory framework and Olaf Wishlist's role

Olaf Wishlist is neither a payment institution nor a payment services agent, and does not need to be: the Service never holds, collects or transfers the money paid into a cash gift pool. Each contribution is collected by Stripe and credited directly to the payment account opened in the beneficiary's name, through Stripe Connect. Olaf Wishlist's role is limited to connecting the beneficiary with their guests and displaying the state of the pool.

The payment service itself is Stripe's responsibility: collection, verification of the beneficiary's identity, anti-money-laundering obligations, holding and transferring the funds, refunds and payment disputes. The beneficiary accepts Stripe's terms when creating their payment account and becomes its holder; the sums received never pass through any Olaf Wishlist account.

Refunds

A contribution is a gift to the beneficiary: as a rule, it can be neither cancelled nor refunded. In exceptional circumstances (cancelled event, obvious error, unauthorized payment), contact our support: requests are reviewed on a case-by-case basis and any refund granted is issued via Stripe. The optional support tip is not returned by default. In the event of a payment dispute with the bank (chargeback), the disputed amount and the associated fees are borne by the beneficiary, in accordance with Stripe's terms.

Beneficiary's Obligations

The beneficiary undertakes to provide accurate information during identity verification, to use the cash gift exclusively in connection with the announced event, and to comply with Stripe's terms of service, which they accept when creating their payment account. It is their responsibility to inquire about any tax or reporting obligations relating to the amounts received; Olaf Wishlist provides no tax advice.

Complaints and Mediation

If your written complaint remains unresolved, you may refer the matter free of charge to the consumer mediator we are registered with, under Articles L.612-1 et seq. of the French Consumer Code: CM2C — Centre de la Médiation de la Consommation de Conciliateurs de Justice, 49 rue de Ponthieu, 75008 Paris, France. Requests are filed online at https://www.cm2c.net/declarer-un-litige.php (details: https://www.cm2c.net). Mediation is optional and does not prevent you from bringing the matter before the courts.

Browser Extension

The browser extension allows extracting product information (title, price, image, URL) from e-commerce web pages to pre-fill an item in your lists. The extension does not access your browsing data outside of pages on which you voluntarily activate it. The Publisher disclaims all responsibility for the accuracy of information extracted from third-party sites.

Liability

Limitation of Liability

The Service is provided "as is". We do not guarantee the absence of errors or interruptions. Our liability shall not be engaged for indirect damages resulting from the use or inability to use the Service.

External Links

The Website may contain links to third-party sites (online stores, etc.). We have no control over these sites and disclaim any responsibility for their content.

Reservations

Item reservations are an organizational tool between group members or visitors of a public list. Olaf Wishlist cannot be held responsible for failure to respect reservations or any dispute between users.

Termination

By the User

You can delete your account at any time from your profile settings. This deletion results in the immediate and irreversible erasure of your data in accordance with our privacy policy.

By the Publisher

We reserve the right to suspend or terminate your account in case of violation of these Terms, without prior notice or compensation.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes take effect upon publication on the Website. In case of substantial changes, we will inform you. Continued use of the Service after modification constitutes acceptance of the new Terms.

Applicable Law and Jurisdiction

These Terms are governed by French law. In the event of a dispute, the parties shall first seek an amicable solution, where appropriate with the help of the consumer mediator (see the "Complaints and Consumer Mediation" section). Failing agreement, the dispute may be brought before the competent French courts. If you are a consumer, you may bring proceedings, at your choice, before one of the courts having territorial jurisdiction under the French Code of Civil Procedure or before the court of the place where you resided when the contract was concluded or when the harmful event occurred. If you reside in another member state of the European Union, you retain the benefit of the mandatory consumer-protection provisions of your country of residence.
